![]() ![]() The primary benefit of a consent foreclosure is that, in most cases, the lender will waive its right to seek a deficiency judgment for the difference between the amount you own on your loan and the proceeds of the eventual sale. The “consent” part of a consent foreclosure, however, means that you are not fighting the foreclosure and you agree to walk away from the property. A consent foreclosure is still a foreclosure in that court enters a judgment of foreclosure against you as the homeowner in default on your loan and the property is turned over to the lender. Negotiating the Terms of a Consent ForeclosureĪ consent foreclosure is a process allowed by the Illinois Mortgage Foreclosure Law (IMFL) that is essentially a pre-trial settlement of the foreclosure proceedings. One such option is a consent foreclosure. In exchange, the lender may be willing to waive its right to pursue a deficiency judgment against you. In some situations, however, the lender may be open to other options that might not cost so much in terms of time, money, and energy. As a result, if the lender wins the foreclosure lawsuit, the lender can seize and sell your home, and you could be left responsible for the difference between the sale price and the amount remaining on your mortgage. Court costs, attorneys’ fees, and other expenses can add up quickly. ![]() Under Illinois law, all foreclosures must be filed in court, and a judicial foreclosure can be a challenging, expensive undertaking for the lender. If you are seriously behind on your mortgage payments, you are in danger of foreclosure. If you are facing the threat of foreclosure, Newland & Newland, LLP can help you determine your best options for resolving these issues, protecting your credit, and eliminating debts. In some cases, a judicial foreclosure may be completed. If objections prevent a homeowner from completing a consent foreclosure, they may need to consider other options. Because junior mortgage lenders may not be able to recover what is owed, they may object to a consent foreclosure. All lenders who have an interest in the property must consent to this type of foreclosure. A consent foreclosure will remove all liens from the title of the home, and a mortgage lender will waive their right to pursue a deficiency judgment to collect any additional amounts owed on a mortgage. ![]() Homeowners should also understand how junior liens such as a second mortgage or home equity line of credit may affect their ability to complete a consent foreclosure. ![]() If this will be a concern, a homeowner may need to determine whether completing a short sale or using a deed in lieu of foreclosure will be a more beneficial option. The completion of a foreclosure will be included in a person’s credit report, which could affect their ability to secure a mortgage in the future. However, homeowners who are considering a consent foreclosure should be sure to understand how this will affect their credit. UPDATE: A consent foreclosure, as described below, may be a beneficial way for a person to relinquish ownership of their home and avoid a deficiency judgment. But for some reason Sony has not really entered whole heartedly into the effects unit market, although you will find Sony effects and even mixing consoles tucked away in professional catalogues. Sony, that well known Japanese electronics company, has acquired something of a reputation in televisions, video cameras, hi-fi, portable stereos - pause for breath - compact disc players, digital tape recorders, digital multitrack recorders and the odd one or two other items. And I for one will love it because I do want a choice of dedicated units which I can add to my personal studio and use in conjunction with my existing multi-effects unit and sundry toys. Not that the multi-effects unit will go away, but manufacturers will soon be trying to persuade us that their XYZ100 is the ultimate reverb, or the ultimate chorus. I predict that we will see more and more single effects units coming onto the market. In that case wouldn't you be better off if you could buy a unit that was dedicated to the function you wanted? You can see what I'm leading up to, but I'll just add another point by saying that if you are already the owner of a multi-effects unit, why might you want to buy another one? The only reason can be that it has a better chorus or distortion or whatever. I'll make an exception in the case of the Zoom 9030 because for a multi-effects unit it is very easy to deal with, but by and large I think that multi-effects units have gone as far as they can. Since the introduction, by Yamaha, of the multi-effects unit in the shape of the famous SPX90, and the later introduction by other manufacturers of units which could provide several effects at the same time, multi-effects units have become more and more powerful but at the same time they have tended to become more and more difficult to use. Anandtech found that, when properly configured, the latest video cards can significantly reduce the H.264 decoding burden on the CPU ATI reduced it by half, and Nvidia reduced it by a fifth. But the configuration, drivers, and software necessary to achieve this acceleration is daunting. If you own a relatively new video card, it is possible to offload some of the video decoding chores from your CPU to your video card's GPU. At least we have a few legitimate uses left for the ridiculous amounts of CPU power we've inherited over the years. They look better in less space, but they also require a lot more CPU power to decode. H.264 and MVC-1, however, are truly next generation encoders. It'll look awful and take up a lot more room than it should. Woe to the poor consumer who buys a HD-DVD or Blu-Ray disc encoded with the ancient MPEG-2 encoder. ![]() Both Blu-Ray and HD-DVD allow three different encoders: Windows Media, by all accounts, offers a very good next generation encoder, but it isn't the only encoder on the block. The mainstream PC is only now catching up to the performance required to watch high definition video.Īll the video samples I cited are in Windows Media format. Dual core does this especially well, although it appears to do so by brute force load sharing rather than any special multiprocessor optimizations in the decoder. Driving 1920x1080 requires a lot of grunt – both in terms of pixel-pushing video bandwidth, and also in terms of CPU power for the advanced encoding used to keep the file size down on these massive resolutions. It clearly requires a lot of CPU horespower to render high definition video. I doubt any PC system could play a true 1080p clip at the time these clips were mastered. I have a sneaking suspicion the reason Microsoft redefined "1080p" as 1440x1080 had to do with performance. Note that DirectX Video Acceleration was enabled in each case. I compared CPU usage in Task Manager during full-screen playback of each clip in Windows Media Player 11 on a few systems I have around the house. Interlacing has a lot of problems and should be avoided whenever possible. Interlaced video modes are generally considered inferior to progressive video modes, and should only be used if you have no way to enable progressive modes. Interlaced means resolution is effectively halved vertically in time frames alternate between odd and even lines each cycle. The official definition of 1080p is 1920x1080, so I'm not sure what Microsoft was thinking there. The official television resolutions break down as follows: You'll also note that Microsoft has an odd definition of 1080p. The resolution is the same, and the bitrate looks comparable. Note that I included the Step Into Liquid promo because it's the only clip on the WMV HD Showcase page that requires an abnormally large amount of CPU power to decode. Most of the clips had similar performance characteristics, so I chose one clip from each category. ![]() But the bitrates and sizes are still representative. It's a tad out of date now – most of these sample high-definition clips were mastered in late 2003 or early 2004, long before HD-DVD or Blu-Ray. I'll start by comparing three clips from the Microsoft Windows Media High Definition Showcase page. I'm seriously considering buying one of the $199 Xbox 360 HD-DVD kits and retrofitting it into my Home Theater PC. You can watch them on your computer without a subscription, but if you want to watch them on an Apple TV or a Roku you need to pay up.Now that HD-DVD and Blu-Ray are starting to enter the market in earnest, I thought I'd revisit HD video playback on the PC. Hulu, to use an American example, offers thousands of shows and movies online for free (with ads). Even better: if that fails, the option of simply opening the browser is always present. A computer means you can watch whatever you want, because clever developers work hard to ensure these sites work with software like XBMC. You just want to watch stuff media companies want to control what you watch, and where. Here are a few reasons to use a computer as your media center. Setting up a computer is a little more work than an out-of-the-box solution, but the advantages far outweigh the downsides. If you try XBMC and don't like it, that's okay: you could set up Plex instead, or look into other options. It's not complicated to hook up a desktop computer to your TV and set it up as your XBMC media center. James outlined why you don't need a smart TV, saying basically that the "smart" bits will be obsolete long before you should be buying a new TV. ![]() ![]() These "Divinsky numbers" are not on the same scale as Elo ratings (the last person on the list, Johannes Zukertort, has a Divinsky number of 873, which would be a beginner-level Elo rating). Considering games played between sixty-four of the strongest players in history, they came up with the following top ten: In contrast to Elo and Sonas's systems, Raymond Keene and Nathan Divinsky's book Warriors of the Mind attempts to establish a rating system claiming to compare directly the strength of players active in different eras, and so determine the strongest player of all time (through December 2004). He also published the following list of the highest ratings ever attained according to calculations done at the start of each month: Rank In 2005, Sonas used Chessmetrics to evaluate historical annual performance ratings and came to the conclusion that Kasparov was dominant for the most years, followed by Karpov and Lasker. Including data until December 2004, the ratings were: Nevertheless, Sonas' website does compare players from different eras. That is the extent of what these ratings can tell us. So while we cannot say that Bobby Fischer in the early 1970s or José Capablanca in the early 1920s were the "strongest" players of all time, we can say with a certain amount of confidence that they were the two most dominant players of all time. Of course, a rating always indicates the level of dominance of a particular player against contemporary peers it says nothing about whether the player is stronger/weaker in their actual technical chess skill than a player far removed from them in time. Sonas, like Elo, claims that it is impossible to compare the strength of players from different eras, saying: According to Sonas, "As soon as you go a month without playing, your Chessmetrics rating will start to drop." One caveat is that a Chessmetrics rating takes into account the frequency of play. This system takes account of many games played after the publication of Elo's book, and claims to take account of the rating inflation that the Elo system has allegedly suffered. Jeff Sonas' rating system is called "Chessmetrics". Many statisticians besides Elo have devised similar methods to retrospectively rate players. He also stated that the process of rating players was in any case rather approximate - he compared it to "the measurement of the position of a cork bobbing up and down on the surface of agitated water with a yard stick tied to a rope and which is swaying in the wind". Įlo said it was futile to attempt to use ratings to compare players from different eras and that they could only measure the strength of a player as compared to their contemporaries. Many people believe that this rise is mostly due to an anomaly known as ratings inflation, making it impractical to compare players of different eras. The average rating of the top 100 players, meanwhile, increased from 2644 to 2703, a 59-point increase. For instance, the average of the top 10 active players rose from 2751 in July 2000 to 2794 in July 2014, a 43-point increase in 14 years. The average Elo rating of top players has risen over time. Table of top 20 rated players of all-time, with date their best ratings were first achieved However, Fischer and Karpov are no longer in the top 20. In 1970, FIDE adopted Elo's system for rating current players, so one way to compare players of different eras is to compare their Elo ratings. It did list January 1978 ratings of 2780 for Fischer and 2725 for Karpov. Though published in 1978, Elo's list did not include five-year averages for later players Bobby Fischer and Anatoly Karpov. 2690: Alexander Alekhine, Paul Morphy, Vasily Smyslov.2720: Mikhail Botvinnik, Emanuel Lasker.According to this system the highest ratings achieved were: He gave ratings to players corresponding to their performance over the best five-year span of their career.
